Disclaimer
By Commissioning me you are acknowledging you have read & agreed to my Terms of Service in its entirety. This is to be treated as a contractual agreement between myself and the customer.User Agreement
By commissioning me, you agree that you have read and accepted all the terms described within the Terms of Service. You will agree here to the policy of using the product for personal, non-profit purposes unless otherwise stated, and provide all credits to me, no matter the commissioned product. Violators will be added to a blacklist indefinitely, and if found necessary legal matters will be taken.General
* I reserve the right to refuse service
* Parties involved are to clearly communicate wants, services, and boundaries to the best of their ability.
* Have References prepared to send when discussing your commission with me
* No 3rd party (Or the customer) may alter my work in any way without expressed permission from myself.
* Under NO CIRCUMSTANCE is my work to be reposted without appropriate credit or used to train any type of AI
* NFT Usage is strictly prohibited
* All commissioned work I hold the right to include within my portfolio. (Work under any NDA will not be added until I am able to officially announce my work on the product)
* Failure to abide by my Terms of Service will result in termination of your commission (If started) & your account being blacklisted. (If you attempt to make a new account/email and harass me following being blacklisted, that account will also be blacklisted and blocked)
* Any attempt to look into my personal life, with the intent of harassment, doxxing, or any malicious intent using any information given from any source will result in accounts being blocked, blacklisted, and reported. (If necessary legal measures will be implemented)
* I reserve the right to keep a record of messages and communications between parties, in the case any misunderstandings or attempt of defamation is made.
If necessary in a need for defense or clarification I reserve the right to publicly or privately release records to involved parties. (As to keep good faith I will not alter any recorded communications in any way, even if it would paint me in a negative way)Commercial Usage Agreement
Any commission ordered with the intent of Commercial Usage must agree to the following Terms:
* The total price of the commission and any other royalties are to be agreed upon upfront.
* The minimum price increase for one-off products is 100% of the original price; Double the end sum
(eg. Vtuber models)
* For commissions planned to be used repeatedly; Royalties are more likely to be discussed.
(eg. Merch - 15% of each sale)The following are considered commercial use:* Reproducing & Selling the Artwork/Product, publicly or privately
* Receiving profit from a medium/platform where you have posted or used my artwork (eg. Youtube, Twitch, a personal site)

Copyright Policy
- I reserve the right to watermark/sign my own work
- I reserve the right to apply protective means to any of my works, to prevent unauthorized usage to train any type of AI software/program
- You are responsible for protecting your ownership over rights to a character design made by me by creating a copy image with your name added as well (ie. through a watermark) when uploading on external sites.
- I retain all copyright over my work, which includes the right to redistribute, reproduce, or use the image as a sample for sales or self-promotion unless otherwise agreed upon.
- I reserve the right to add any commissioned work to my portfolio and post to my socials; Work under NDA once more will be kept private until cleared with the commissioning party to reveal my part in the work.
- I will not claim the rights to a character design, unless it was one of my own designs
- I will not reuse or resell any previously commissioned work for personal or commercial projects or profit unless previously agreed upon with the original customer.
- In the case of adoptable designs (or similar products), I will not reuse/resell the rights of the design once ownership is transferred to you, the customer.

NDA Policy
* Any desire to have your commission remain private until an agreed time to publicly announce it, must be stated during the ordering process.
* If an NDA is applied to a commission it automatically implies that I am not able to share any WIPs, Stream/post the process of creating the commission, or share the final product until the customer has given permission or a specific time where I am allowed to release my work on said commission.
* Terms of NDA must be agreed upon during the ordering process. Including a given time to release my work on a commission.
(eg. Any work done for a Vtuber debut may be released after the debut of the individual is complete)
The NDA fee starts at +10% of the total quote, but may differ.

Refund Policy
- Refunds are only permitted under specific circumstances.
(That being said, please make sure finances are in order before commissioning.)
Cancellations
- If you cancel before I manage to work on anything regarding your commission, I will grant a refund for 85% of the paid amount. I will keep 15% for the consultation time.
- If the commission is complete and you have already paid in full, then no cancellation or refund will be granted.
- If something comes up and I am unable to or choose not to complete your commission, I will issue a refund for any additional amount already paid, in which I have not completed work for.
(eg. You have paid in full, I have your commission half complete but cannot work on it anymore, You get back the amount of money that covered parts of the commission not complete.)
Chargebacks
- Any attempt at a chargeback (or a similar action) after the final product has been delivered to the customer, will result in your account being blacklisted, and I will likely look into compensation by means, legal if necessary. As I consider such actions theft.
(If the chargeback was unintentional and you intend on paying, please contact me immediately.)

Revisions & Feedback
I define Revision as - To change or fix something- I allow 3 large revisions during the sketching process
- For smaller revisions I may allow for more than 3
- Please try to list all revisions at once as you notice them
- I will not do revisions past the sketching process, so please try to make sure everything looks good before we agree to move onto the next stage.*I welcome feedback but please maintain a polite attitude as a rude one may result in me cancelling your commission (see cancellations section for additional details) In return I will also do my best to remain polite as well.

Commissions
Ordering
When ordering from me, I will have each customer fill out a form to request a commission.
Its purpose is :
- To summarize to me what you are looking for and the general concept/details
- Have all requests for commissions in a common area to keep track of
- Serve as additional confirmation that you have read my Terms of ServiceAfter the form is submitted, I will review it as soon as I can and reach out to you via the provided social information.
Please note that depending on how many commissions I have taken on at a given time, I may ask if you would like to be placed on a waitlist if I am unable to take on your commission at the given moment.Please Note as well that with the exception of NDA Work, I keep a public spreadsheet for all commissions.
This will Include :
- Given name (usually the username on the platform being used for communications) of the the customer
- Platform being used for communication
- Payment status (eg. Payment fulfilled 50%; Payment fulfilled)
- Stage in the commissioning process. (eg. Sketching; rendering)NDA Work will have a spreadsheet as well, the only difference is that the spreadsheet will only be seen by me & remain private.Queue/Scheduling/Deadlines
- I will not give any set Deadlines; however if requested I can give an estimate to when I feel at the time of discussion, I will complete a commission
- If I cannot take on your commission at the moment of reviewing your request form, I will reach out and ask if you would like to be added to the waitlist
If you have been placed on the waitlist, I will reach back out to you when I am able to begin work for your commission.
- If at any point you become no longer interested in commissioning me feel free to reach out so I can update my list as soon as possibleI will contact you when your commission is ready to enter a new stage of the productionFinal Product
- Before I send the final product, services must be paid in full
Reminder: No edits by the customer or a 3rd party is allowed without my expressed permission
- For illustrations I will send a watermarked copy; however you are more than welcome to ask for a non-watermarked copy as well, which will have no additional charge.You are still expected to credit me and abide by my rules regarding prohibited AI usage, NFT usage, etc.If I find you have violated the above conditions I will have u blacklisted and look into pursuing legal matters- There may be slight differences from my samples and the final product; customer must respect that my artistic style cannot be altered
- Credit to me as the artist must be provided when posting or sharing the commissioned work
- The customer is responsible for saving any information, files, or other digital data I provide; the files can only be requested from me again for a finite time
(3 months; although not guaranteed due to any unfortunate circumstances. Example: accidental deletion)
- I am not required to post your commission on my socials

Below are the Following Services I use for Payment:

• PayPal

Payment- I am not responsible for any mistakes made on your part over the course of the transaction
- All Prices are in USD; you will be responsible for currency conversions
- 100% of the total price upfront is preferred; On smaller commissions I may allow payment plans (Likely 50% upfront & 50% upon completion of commission), however on larger more time-consuming commissions I am unlikely to allow a payment plan
- I will initiate the transaction (via invoice method unless stated otherwise) to avoid accidental transactions
- Do not send any payment before I have confirmed your commission and asked
- I will cover fees for payment platforms
- I do not accept payment from shared accounts
- If payment is not made in a timely manner (72 hr) after the invoice has been sent, it will result in the cancellation of your commission.
(Repeatedly commissioning work and failure to pay will result in blacklisting.)
- For any raffles or similar events; do not enter if you are not financially prepared to meet the conditions of the ToS or the event specific rules/guidelinesPayment Method Disclaimer
- Please note that all of my sales are “Digital Artwork”; Meaning the artwork’s “intellectual property” is what you are purchasing
- Nothing is intended by me or the customer to ever be physically shipped
- I am not ever required to physically ship an item, unless it was explicitly discussed

Rush Fee
*My Rush fee is subject to change depending on the amount of time I can spend working on commissions & the amount of time a regular commission would takeAs of August 2026 any rush fee will be a 25% increase of the end sumNDA Fee
